What is RERA and how does it protect homebuyers? +
The Real Estate (Regulation and Development) Act, 2016 (RERA) is India's comprehensive law protecting real estate buyers. It mandates builder transparency, project registration, escrow maintenance, and provides for interest compensation for delay, full refund for non-delivery, and 5-year structural warranty. Every state has its own RERA authority enforcing these rights.
How much compensation can I get for builder delay under RERA? +
RERA mandates interest at SBI MCLR+1% per annum (currently approximately 10.85%) on all amounts paid, from the due date of possession to actual possession. For a ₹50 lakh investment with 3-year delay, this amounts to approximately ₹15-16 lakh. This is enforceable as a court decree.
Can I get full refund from a builder under RERA? +
Yes. RERA Section 18 provides that if the builder fails to complete the project or hand over possession as agreed, you are entitled to a full refund of all amounts paid with interest. This applies even if you bought the property years ago.
How long does a RERA complaint take? +
RERA mandates disposal of complaints within 60 days. In practice, straightforward cases may take 3-6 months, complex cases up to 1 year at the authority level. This is still significantly faster than consumer forums (2-5 years) or civil courts (5-15 years).
What if my builder has filed for insolvency? +
Insolvency (NCLT proceedings) may stay RERA recovery, but RERA complaints can still be filed to establish your claim. Homebuyers have been recognized as financial creditors under IBC, giving them priority in resolution. Adv. Kanika Rao advises on the optimal multi-forum strategy in such cases.
